
Description
We are seeking a highly motivated and experienced patent attorney to join our growing legal team on a part-time basis (approximately 2 days per week). Reporting to the General Counsel, the Head of IP will advise Abpro on a wide range of intellectual property matters, including developing IP strategies, patent prosecution, patent portfolio management, licensing, due diligence, and freedom-to-operate analyses. The successful candidate will possess extensive patent drafting and prosecution experience, deep industry understanding, strong analytical and communication skills, and experience working directly with key stakeholders, including R&D, technology, and business development on all intellectual property and related legal matters.
Responsibilities:
- Assist in the development and execution of Abpro’s patent strategy.
- Work closely with research and development to advise and guide intellectual property development and strategy.
- Draft patent applications working with external counsel as needed.
- Partner with business development on in-licensing and out-licensing transactions.
- Conduct or direct freedom to operate studies, analyses of third-party patent positions, and competitive patent intelligence.
- Manage publications review relating to intellectual property matters.
- Manage patent prosecution docket matters working with external counsel as needed.
- Assist as needed with day-to-day legal matters including review of industry-typical contracts.
Requirements
- J.D. from a major accredited law school, an advanced degree in immunology, molecular or cellular biology or similar discipline preferred.
- Registration to practice before the U.S. Patent and Trademark Office.
- Experience in Patent strategy and licensing.
- Experience in drafting and executing various types of contracts, (e.g., licenses, clinical trial agreements, vendor and supply agreements).
- 7+ years prior experience drafting and prosecuting patent applications and conducting freedom to operate analyses in the biotech and/or pharmaceutical areas.
- Experience in a biotechnology company or pharmaceutical company preferred.
- Proven track record developing and implementing patent strategies with demonstrated success securing meaningful patent protection for products and technology platforms.
- Experience assessing concerns, identifying, and managing risk, and proactively managing outcomes with creative strategic planning.
